1. Auctions will be open to both Dealers and the General Public.
2. All persons attending auction to purchase a vehicle must register and obtain a bidder number in order to bid on any vehicle.
3. All vehicles cosigned must be offered for sale on the auction block and transacted through our office.
4. IF YOU SUCCESSFULLY WIN THE BID ON A VEHICLE, YOU HAVE LEGALLY BOUGHT THAT VEHICLE. All General Public winning bidders are required to pay a same-day NON-REFUNDABLE payment of at least $200.00 as good faith earnest money to hold the vehicle for said bidder for 48 hours (2 business days). General Public buyers must pay remainder balance within 48 hours (2 business days) of paying earnest money. Failure to meet payment requirements shall result in buyer’s forfeiture of earnest money. Dealers must pay full amount of purchase the same day of the auction.
5. Auction fees are as outlined below:
SELLER FEES:
$150 for sale price of $100 to $1000
$175 for sale price of $1001 to $2000
$200 for sale price of $2001 to $4000
$225 for sale price of $4001 to $7000
$250 for sale price of $7001 or higher
After vehicle is sold, seller will receive a check in the amount of the agreed-upon sale price minus the above outlined seller’s fee.
Registration Fee: $50 For 3 (three) weeks. $15 each additional week. ALL FEES ARE NON-REFUNDABLE.
BUYER FEE:
$150 per vehicle
BUYER’S FEE WILL BE ADDING TO WINNING BID. Total amount (winning bid + buyer’s fee) is due from buyer before St. Charles Public Auto Auction, LLC will release the vehicle to said buyer.
6. Form of payment must be made in CASH ONLY. Any other form of payment must have prior approval by St. Charles Public Auto Auction, LLC office management.
7. All vehicles sold and/or purchased at the auction are AS IS, WHERE IS. St. Charles Public Auto Auction, LLC assumes no responsibility for condition of vehicles, warranties, or guarantees made between seller and buyer. St. Charles Public Auto Auction, LLC reports to the bidders all information given by the seller and assumes no responsibility for the accuracy of the claim(s). Auction block will announce if vehicles are under or over 100,000 miles. Auction block will announce if the vehicle has a Prior Salvage title. If a discrepancy later occurs, it is between the seller and the buyer.
8. PRIOR SALVAGE titles must be announced at time of sale or sale may be voided.
9. All commercial vehicles, taxis, police cars, etc. must be announced. Additionally, all diesel engine vehicles, vehicles with engine changed or alterations, and vehicles with frame or flood damage must be announced. Failure to notify St. Charles Public Auto Auction, LLC of any of these vehicle types may void the sale.
10. St. Charles Public Auto Auction, LLC assumes no responsibility and shall not be held liable for the mechanical or physical condition of any vehicle represented before, during, or after the auction. It is the responsibility of all owners/sellers/dealers to carry appropriate insurance. ANY/ALL guarantees, promises, or conditions made between seller and buyer must appear on the sales invoice.
11. TITLES: Dealer seller titles must be submitted to Auction office within 30 (thirty) days. If not submitted within this time, seller will be charged a $50 late fee, and buyer has the option to return the vehicle for original purchase price (vehicle must be returned within 3 working days). If vehicle is returned, the seller will be required to pay the commission (seller's fee) that was due to St. Charles Public Auto Auction, LLC. In order for a buyer to obtain a full refund of the original purchase price upon return of the vehicle due to the failure of the seller to deliver the title to St. Charles Public Auto Auction, LLC within thirty days of the date of sale, the vehicle must be in the same condition as it was on the date of sale, except for normal wear and tear on the vehicle. If the vehicle is not in the same condition, St. Charles Public Auto Auction, LLC has the option in its sole discretion to:
1) refuse to accept the returned vehicle, in which event, St. Charles Public Auto Auction, LLC shall not be required to refund any of the purchase price, or
2) St. Charles Public Auto Auction, LLC may deduct from the original purchase price in determining the amount of such refund any costs required to repair the vehicle so that it is in the same condition as it was on the date of sale, except for normal wear and tear on the vehicle.
Furthermore, after a vehicle is purchased and the buyer has not yet received the title, the buyer should not make any repairs, resell, or put any money whatsoever in said vehicle (other than to proceed with normal operation of the vehicle, such as gasoline) until the title is actually received by the buyer. The buyer will not be reimbursed for any amounts spent on said vehicle, but rather will only receive the sales price and buyer’s fee if the title is not received by St. Charles Public Auto Auction, LLC within 30 (thirty) days.
General Public sellers must have and submit a transferable title at time of registration at St. Charles Public Auto Auction, LLC. ALL titles must be clear of any liens, or must be accompanied by a valid lien release.
12. No purchased vehicle will be allowed to leave the Auction premises without written approval from St. Charles Public Auto Auction, LLC office personnel.
13. Racing engines in and around the building will be PROHIBITED.
14. It will be the General Public’s responsibility to keep their children safe. Keep children out of vehicles and out of the drive-through while inspecting vehicles and out of the Auction block during the time vehicles are being driven through the building and in the parking lots.
15. All persons attending the auction shall be inside the building at the start of the auction. NO ONE other than St. Charles Public Auto Auction, LLC personnel will be allowed on the lot during the auction.
16. All vehicles that do not run and are left on the auction premises for more than 7 (seven) days will be charged a storage fee of $7 per day to the owner of the vehicle. These fees are due on a weekly basis.
17. ALL COMPLAINTS AND REJECTIONS WILL BE HANDLED BY ST. CHARLES PUBLIC AUTO AUCTION, LLC MANAGEMENT, AND ALL DECISIONS ARE FINAL.
